Rental Agreement and Waiver for Generator Program *

By participating in the Generator Donation and Battery Swap Program, you (the Recipient) agree to the following terms and conditions set by Twenty Eight West | Toybox Rentals (the Lessor): 1. Use of Equipment The equipment (generator and/or batteries) is loaned free of charge for recovery purposes only. The Recipient agrees to use the equipment responsibly and follow all provided safety guidelines. The Lessor is not responsible for any injuries, property damage, or other liabilities resulting from the use or misuse of the equipment. 2. Pickup, Delivery, and Returns Equipment may be picked up from the Lessor’s 24/7 lockers or delivered to the Recipient’s address, as arranged during the application process. Battery swaps must be completed by returning the depleted battery to the designated location before receiving a fully charged one. 3. Care and Responsibility The Recipient assumes all responsibility for the equipment from the moment it is picked up or delivered. The equipment must be returned in the same condition it was received, excluding normal wear and tear. Any damage, loss, or theft of equipment during the loan period will result in the Recipient being responsible for repair or replacement costs. 4. Risk of Loss The Recipient is responsible for any loss or damage to the equipment while in their custody, regardless of cause. The Lessor reserves the right to determine whether equipment should be repaired or replaced. 5. Liability Waiver The Recipient agrees to hold the Lessor harmless from any claims, damages, or losses arising from the use of the equipment. The Lessor does not guarantee uninterrupted operation of the equipment and is not liable for any delays, losses, or inconvenience resulting from equipment failure. 6. Eligibility Verification The Recipient certifies that the information provided in the application is accurate and truthful. Proof of residence in fire-affected areas and acknowledgment of terms is required for participation in the program. 7. Late Returns or Non-Returns All equipment must be returned promptly after use. The Lessor reserves the right to charge penalties for late returns or non-returns, including barring future participation in the program. 8. Entire Agreement This agreement represents the entire understanding between the Lessor and the Recipient regarding the loaned equipment. This agreement is governed by the laws of California.
